General sales terms

All online sales made from the company NEWD Italy with registered office and sales point in Piazza Puliti 11R, 50121, Florence, and owner of the website www.newd.it, will be governed by the following conditions:

 

Online orders and conclusion of the sales contract

The online sales are finalised at the time NEWD Italy receives the online purchase order of the product or products selected and transmitted to the newd.it website by the Customer. The transmitting of the purchase order online implies the Customer’s full knowledge of these General Sales Terms together with their full acceptance, as well as consent to receive further communications from NEWD Italy.

The Customer agrees and undertakes to print and keep these General Sales Terms that have already been read and accepted before transmitting the purchase online.

Following the conclusion of the sales contract, NEWD Italy shall send the Customer the products ordered against receipt of payment for the same, in accordance with the methods and conditions set down in these General Sales Terms.

After receiving the purchase order, NEWD Italy shall take care of sending an email to the address indicated by the Customer, containing a detailed description of the purchase order and assigning the Customer a "Customer Order Number" that must be used for all further communications with NEWD Italy. This online message must not however be considered as an order confirmation as the contract has already been finalised at the time of receiving the order.

On sending the online purchase order, the Customer must confirm to be over the age of 18.

 

Partial deliveries

On receiving the purchase order, NEWD Italy will check the effective availability in the warehouse of the goods requested while also observing the “in-factory delivery procedures” necessary for carrying out the order.

NEWD Italy shall be explicitly entitled to make partial orders of the goods requested, depending on the availability of the goods at the time of shipping and in accordance with the aforementioned delivery procedures, without in any way exonerating the Customer from his/her obligation to pay for the order according to the terms agreed to, irrespective of the products and quantities delivered in the partial shipment.

NEWD Italy shall in all cases have the right to withdraw from the purchase agreement with regard to the part still not delivered, without the Customer being entitled to claim for reimbursement of damages or indemnities of any kind whatsoever.

 

Collection of the products care of the sales point.

Except where otherwise established by art. 5 hereunder, the products ordered will be delivered to the sales point of NEWD Italy in Piazza Puliti 11R, 50121, Florence.

The products will be available for collection by the Customer for seven working days from the day after the date on which NEWD Italy has received the purchase order. Once this term has elapsed, the purchase order shall be considered as automatically cancelled.

In order to be able to collect the products ordered, the Customer must go to the aforementioned address with a copy of the communication received by email at the time of transmitting the order.

 

Shipping of the products

If requested by the Customer the products of the purchase order may be sent directly to the domicile indicated by the Customer in the purchase order. In this case NEWD Italy shall deliver the goods to the Customer, and the delivery shall be carried out in the name of and on behalf of the Customer.

NEWD Italy shall take care of contacting one of its trusted carriers – on behalf of the Customer – or if at the Customer’s request, a carrier indicated by the same at the time of placing the order. The obligation of NEWD Italy to deliver the products ordered shall be considered as regularly terminated at the time the package containing the goods ordered is handed over to the carrier assigned to the transport. The risks and charges of the transport shall be exclusively to the account of the Customer. In order to exonerate the Customer from any risks, unless otherwise indicated by the same at the time of placing the order, all the deliveries shall be insured for the overall value of the order without any further charges.

The delivery times indicated on the newd.it website are to be considered as merely indicative and not binding. Any delays and/or misunderstandings, or any similar events that take place during the delivery of the products must therefore be attributed solely to the carrier entrusted with the transport. In the hypothesis of delays and/or misunderstandings or similar events during the transportation of the goods ordered, the Customer consequently agrees not to advance any claims for refunds/replacements from NEWD Italy.

Deliveries to the smaller Italian islands or any remote areas will be subject to an additional charge of € 5.

At the time of delivery by the carrier, the Customer receiving the goods must check that the packages all have their guarantee seals and identification labels intact, and it must immediately notify any justified reservations or complaints. Said justified reservations or complaints must be notified to the carrier by registered letter within three (3) working days after the delivery.

Should the products delivered fail to comply by type or quality to those indicated on the shipping bill, the Customer must send in a complaint within ten (10) days after receipt of the same, otherwise it shall lose all rights in this regard.

 

Sales price and payment methods

All the sales prices of the products illustrated and indicated in the store of NEWD Italy as well as the ones contained on the www.newd.it website, are inclusive of all taxes, without however including any freight charges.

The freight charges for all purchase orders transmitted online are indicated on the relative page of the www.newd.it website which the customer must read carefully before confirming the order. These charges must be paid by the Customer at the time of paying for the price of the order.

The payment of the price of the goods ordered by the Customer will be made by means of the method selected online at the time of placing the purchase order, and more specifically: by COD, credit card, or bank transfer in advance.

 

Right to withdrawal ("Satisfied or money back" guarantee)

The Customer shall be entitled to withdraw from the purchase agreement for any reason whatsoever, without having to give explanations and without having to pay a fine, except in the case of the provisions set forth in the following paragraphs.

In order to exercise this right, the Customer must send the relative online form to NEWD Italy duly filled out, within 10 working days after the date of receipt. Once the NEWD Italy Customer Service receives the above-mentioned request it will send the Customer instructions for returning the goods that must be sent to NEWD Italy within 10 days after the authorisation of the return.

 

The right to withdraw shall in any case be subject to the following conditions:

-  The right to withdraw is applicable to the single product purchased in its entirety; it is not possible to exert this right to only a part of the product purchased;

-  The product purchased must be intact, in its original conditions, bearing the unopened seal of guarantee or identification label, not tampered with, and returned in its original packaging; in order to reduce damage to the original packaging, we recommend whenever possible to insert the box into another box and to affix the label supplied by NEWD Italy bearing the RMA (Return Authorisation Code) to the same; in all cases it is necessary to avoid affixing labels or adhesive tape directly onto the original packaging of the product;

-  The shipping expenses relating to the return of the product are by law charged to the Customer’s account;

-  The shipping up until the certified receipt at our warehouse, is the complete responsibility of the Customer;

-  In the case of damage to the goods during transport, NEWD Italy will inform the Customer of the same (within 5 working days after receipt of the goods in its warehouse), in order to allow the latter to advance a complaint to the carrier chosen by the same in a timely manner and to receive a refund for the value of the goods (if insured); in this event, the product will be made available for the Customer for its return, and at the same time the request for withdrawal will be cancelled;

-  NEWD Italy shall in no way be liable for damage or theft/loss of the goods returned with deliveries that are not insured;

-  On its arrival in the warehouse, the product will be examined for assessing any damage or tampering with not deriving from the transport. Should the original box and/or packaging be damaged, NEWD Italy shall be entitled to deduct a percentage not exceeding 10% from the same as a contribution towards the expenses for repairs.

Notwithstanding any expenses for repairs for ascertained damaged to the original packaging, NEWD Italy shall refund the Customer for the full amount paid within 14 days after the return of the goods, either by a deduction against the amount charged to the credit card or via bank transfer. In the latter case it will be the Customer’s responsibility to provide the bank information in a timely manner for obtaining the refund (IBAN code- with the account number of the name the invoice is made out to.

 

The right to withdraw shall be invalidated in the case of the RMA code missing on the returns, or in the absence of the essential intactness conditions of the goods (seal of guarantee and/or contents), and in the cases in which NEWD Italy ascertains:

-  The absence of the original internal packing;

-  The absence of the integrating elements of the product (brands, seals of guarantee, etc.);

-  Damage to the product for causes differing from the transport.

 

Protecting of personal data

In the aim of ensuring a punctual fulfilment of the obligations deriving from the sales agreement with the Customer, the latter shall be obliged to provide his/her personal data. The handling of all personal data shall be based on lawfulness and correctness, in full observance of the Customer’s rights, in particular those regarding confidentiality. The personal data shall be handled in full observance of the laws, regulations, and norms in force in Italy. The personal data provided at the time of acceptance of these General Sales Terms, wherever the customer intends proceeding with the purchase of the product online, will be handled by NEWD Italy in an electronic manner, in full compliance with the regulations in force regarding security and in such a way as to conserve and guarantee confidentiality of the same.

The personal data supplied by the Customer shall be used by NEWD Italy exclusively for pursuing the commercial purposes connected to its own business. The personal data will not therefore be communicated to third parties or circulated.

The holder of the personal data is NEWD Italy, Piazza Puliti 11R, 50121, Florence.

 

Complaints

Any complaints must be sent to NEWD Italy, Piazza Puliti 11R, 50121, Florence

 

Applicable legislation and competent court

The sale agreement between the Customer and NEWD Italy is intended as concluded in Italy and as such it will consequently be governed by the Law of the Republic of Italy. All disputes arising in relation to the validity, interpretation or execution of the sales contract shall be settled by the Judicial Authorities of the Court of the Republic of Italy.
